Bioxyne

Bioxyne has filed a summons in the NSW Supreme Court against major shareholder Ian Owles alleging he made misrepresentations resulting in shares being issued to him.

Owles became a significant shareholder in Bioxyne, holding around 6.1%, in May 2023.

Bioxyne told the ASX: “The claim seeks relief pursuant to sections 236 and 237 of the Australian Consumer Law (NSW) arising from misrepresentations made by Mr Owles which led to the issue of shares to him in Bioxyne.”

The company is claiming relief for loss and damage, or alternatively that the shares issued to Owles be declared void from the outset, or that he not be entitled to enforce his rights in respect of the shares.

Bioxyne said the summons has “no impact” on its successful operations. No further details were given.
