Legalise Cannabis Western Australia MP Dr Brian Walker has tabled a bill that would allow adults to grow up to six plants at home, possess up to 50 grams for personal use, and share up to 50g as a gift.
The Misuse of Drugs (Lawful Personal Use of Cannabis) Amendment Bill 2026, introduced in the WA Legislative Council last week, would amend the current act to essentially legalise personal cannabis use for adults.

Public consumption and sale would remain prohibited, while existing adult cannabis infringement notices would cease to have effect.
Walker – a GP of 46 years – said the bill was about ending the criminalisation of everyday West Australians.
“This bill is about common sense,” Walker said. “It’s about treating adults as adults, freeing up police resources, and ending the criminalisation of everyday Western Australians for a plant that is legal in jurisdictions across the globe.”
The party said the bill would complement the existing medical scheme.
“Right now, medicinal cannabis patients pay hundreds of dollars a month for products their GP wants to prescribe,” the party said.
“This bill would allow any adult to grow their own – meaning patients who can’t afford the pharmacy have another option. It doesn’t replace medical supervision. It removes a barrier.”
